1. Parties and subject
This agreement is concluded between the person/business creating a maker profile or wishing to publish product content on Tospika (the “Maker”) and Tospika. It sets out the terms for listing the Maker's profile and product content.
The Maker confirms that the information provided during registration and publication is accurate, current and their own.
2. Tospika's service and separation from sales
Tospika provides only promotional and listing space. It does not sell the Maker's products, take payments or manage orders, shipping, delivery, returns, exchanges or customer service.
Any sale, order, payment or delivery relationship formed through external channels is solely the responsibility of the relevant parties. Makers are responsible for identifying and complying with tax, invoicing, consumer, product safety, distance-selling and other obligations applicable to their own activities.
3. Profile and product publication
Publication may require completing the basic profile information requested by Tospika and adding at least one product. Tospika may decline to publish profiles without products or sufficient information.
Profile and product content added or changed by a Maker may be reviewed before or after publication. Tospika may request corrections or temporarily or permanently remove content that is incomplete, misleading, at risk of infringing copyright or contrary to platform principles.
4. Maker's declarations and obligations
The Maker declares and undertakes that:
- all profile and product information is accurate, current, genuine and not misleading;
- they hold the necessary rights to product images, videos, text, designs, brand use and other content;
- they will not infringe third-party copyright, trademarks, designs, personality or other rights;
- they will provide accurate information about product characteristics, materials, dimensions, care, age suitability, small-part/accessory safety and applicable warnings;
- they are responsible for all communications, offers, sales, payments, delivery, returns and disputes with visitors;
- they will comply with all applicable legislation and tax and consumer obligations.
5. Content licence
The Maker grants Tospika a free, worldwide, non-exclusive licence to publish, technically reproduce, resize and create previews of uploaded profile, product, image, video, text and similar content, and to use it on Tospika's own social media or promotional channels to promote the Maker or their products.
This permission applies while the content remains published on Tospika. The Maker may request removal; technical caches and earlier shares will be updated within a reasonable time.
6. Prohibited content and conduct
Makers must not present another person's product photo or model as their own work, use counterfeit or misleading branding, list prohibited or unlawful products, provide false prices or production times or act in a way that harms Tospika's reputation or security.
7. Review, suspension and termination
If a breach of this agreement or the law is suspected, Tospika may request explanations or documents, hide content, suspend a profile or terminate membership. Prior notice is not required in cases of urgent risk, copyright infringement, suspected fraud or legal obligations.
The Maker agrees to indemnify Tospika against third-party claims, administrative sanctions, damages and reasonable legal costs to the extent arising from the Maker's own actions and content.
8. Ending the agreement
The Maker may request account closure by emailing merhaba@tospika.com. Tospika may also terminate membership for a reasonable cause. Termination does not remove the Maker's responsibility for previous sales, content or obligations.
9. Effect and contact
The agreement takes effect when the Maker accepts it during registration. Contact: merhaba@tospika.com
In the event of a dispute, the Turkish text shall prevail.
